DMCA Policy for Öpnv Streik Anreise

Öpnv Streik Anreise respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will respond promptly to claims of copyright infringement committed using the Öpnv Streik Anreise service and/or website (the "Service") if such claims are reported to our designated Copyright Agent identified below.

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Service by completing the following DMCA Notice of Alleged Infringement and delivering it to our designated Copyright Agent.

Filing a DMCA Notice of Alleged Infringement

To file a notice of alleged infringement, please provide our Copyright Agent with the following information in writing:

  1. Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by this Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL of the page containing the material).
  3. Provide information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
  4. Include the following statement: "I have a good faith belief that the use of the copyrighted material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  5. Include the following statement: "I swear, under penalty of perjury, that the information in this Notice is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  6. Your physical or electronic signature.

Once this information is received, Öpnv Streik Anreise may act to remove or disable access to the infringing material. We may also notify the alleged infringer of your claim and provide them with your contact information to allow them to respond directly.

Filing a DMCA Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information in writing to our Copyright Agent:

  • Identify the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or access to it was disabled.
  • Provide your name, address, telephone number, and email address.
  • Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
  • Include the following statement: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, for any judicial district in which Öpnv Streik Anreise may be found, and I will accept service of process from the person who provided the original notification of infringement or an agent of such person."
  • Your physical or electronic signature.

Upon receipt of a valid counter-notification, Öpnv Streik Anreise may forward it to the party who submitted the original DMCA Notice. The original complainant then has 10 to 14 business days to file a court action against you. If no such action is filed within that timeframe, Öpnv Streik Anreise may restore the removed material or re-enable access to it.
